Penghapusan pasal 46 terkait kewenangan BPH Migas disebutnya sudah sesuai kesepakatan rapat Panitia Kerja Badan Legislasi (Panja Baleg) di DPR.<\/p>\n<p>&#8220;Setneg dalam hal ini justru melakukan tugasnya dengan baik. Dalam proses\u00a0<em>cleansing<\/em>\u00a0final sebelum naskah dibawa ke Presiden, Setneg menangkap apa yang seharusnya tidak ada dalam UU Cipta Kerja dan mengkomunikasikan hal tersebut dengan DPR. Penghapusan Pasal 46 tersebut justru menjadikan substansi menjadi sejalan dengan apa yang sudah disepakati dalam rapat Panja,&#8221; kata juru bicara Presiden Jokowi Bidang Hukum, Dini Purwono, lewat pesan singkat, Jumat (23\/10\/2020).<\/p>\n<p>Keberadaan pasal itu diketahui setelah dilakukan pengecekan dari pihak Setneg dan DPR. Akhirnya disepakati nasib pasal itu dikembalikan ke keputusan Panja yang menyebutkan pasal itu tidak seharusnya ada dalam\u00a0UU Cipta Kerja.<\/p>\n<p>&#8220;Yang tidak boleh diubah itu substansi. Dalam hal ini penghapusan tersebut sifatnya administratif\/<em>typo<\/em>\u00a0dan justru membuat substansi menjadi sesuai dengan apa yang sudah disetujui dalam rapat Panja Baleg DPR,&#8221; ujar Dini.<\/p>\n<p>&#8220;Intinya, Pasal 46 tersebut memang seharusnya tidak ada dalam naskah final karena dalam rapat Panja memang sudah diputuskan untuk pasal tersebut kembali ke aturan dalam UU\u00a0<em>existing<\/em>,&#8221; jelas Dini.<\/p>\n<p>Dini melanjutkan ada tiga dasar dilakukan perubahan terhadap draf\u00a0UU Cipta Kerja. Ketiganya adalah supaya substansi sesuai dengan hasil rapat di DPR, dengan sepengetahuan DPR, dan diparaf oleh DPR.<\/p>\n<p>&#8220;Yang jelas perubahan dilakukan.\u00a0<strong>Pertama<\/strong>, agar substansi sesuai dengan yang disepakati dalam rapat panja.\u00a0<strong>Kedua<\/strong>, dengan sepengetahuan DPR. Dan\u00a0<strong>ketiga<\/strong>, diparaf oleh DPR. Perubahan dilakukan dengan proper. Itu yang penting,&#8221; ujarnya.<\/p>\n<p>Naskah UU Cipta Kerja yang paling terbaru berjumlah 1.187 halaman, yang awalnya 812 halaman. Menteri Sekretaris Negara (Mensesneg) Pratikno menjelaskan perubahan jumlah halaman itu lantaran dilakukannya\u00a0<em>formatting<\/em>\u00a0dan pengecekan teknis oleh Kementerian Sekretariat Negara (Kemensetneg). Proses itu, menurut dia, memang harus dilewati sebelum sebuah undang-undang disampaikan ke presiden dan diundangkan.<\/p>\n<p>&#8220;Sebelum disampaikan kepada presiden, setiap naskah RUU dilakukan\u00a0<em>formatting<\/em>\u00a0dan pengecekan teknis terlebih dahulu oleh Kementerian Sekretariat Negara agar siap untuk diundangkan.
